End User License Agreement (EULA)

1. Agreement to Terms
This End User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and Salvage Empire ("Licensor," "we," "us," or "our") for the Salvage Empire mobile game application ("Software" or "Game").
BY DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.
2. License Grant
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software on compatible mobile devices that you own or control, solely for your personal, non-commercial use.
3. License Restrictions
You shall not:
- Copy, modify, adapt, translate, or create derivative works of the Software.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
- Remove, alter, or obscure any proprietary notices (copyright, trademark, etc.) on the Software.
- Rent, lease, lend, sell, redistribute, or sublicense the Software.
- Use the Software for any commercial purpose or public display.
- Use the Software in any manner that violates applicable laws or regulations.
- Use cheats, exploits, automation software, bots, hacks, or mods.
- Attempt to gain unauthorized access to the Software, servers, or networks.
- Interfere with or disrupt the Software or servers.
- Extract, scrape, or harvest data from the Software.
4. Ownership and Intellectual Property
The Software and all copyrights, trademarks, trade secrets, patents, and other intellectual property rights associated with it are and shall remain the exclusive property of Salvage Empire and its licensors.
This EULA does not grant you any rights to:
- Trademarks or service marks of Salvage Empire.
- Patents, copyrights, or trade secrets.
- Any intellectual property not expressly granted herein.
5. Virtual Items and Currency
5.1 Virtual Property
The Software includes virtual items such as:
- Virtual currency (Cash and Gold Bars)
- Vehicles and vehicle parts
- Garage slots and upgrades
- Tools and equipment
- Cosmetic items and customizations
5.2 No Real-World Value
Virtual items have no real-world value and cannot be:
- Sold, traded, or transferred outside the Software.
- Exchanged for real money or anything of monetary value.
- Inherited, bequeathed, or transferred upon death.
5.3 License to Virtual Items
You do not own virtual items; you receive a limited license to use them within the Software. We reserve the right to modify, remove, or delete virtual items at any time.
5.4 Purchases
In-app purchases are processed through the App Store (iOS) or Google Play Store (Android). All purchases are final and non-refundable except as required by law.
6. User-Generated Content
If you submit content to the Software (feedback, suggestions, bug reports), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and distribute such content for any purpose.
7. Updates and Modifications
We may provide updates, patches, or modifications to the Software. You agree that:
- Updates may be automatically downloaded and installed.
- Updates may change game features, mechanics, or content.
- Continued use of the Software requires accepting updates.
- We may discontinue support for older versions.
8. Data Collection and Privacy
Your use of the Software is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Software, you consent to our data practices as described in the Privacy Policy.
9. Internet Connection
Certain features of the Software require an internet connection. You are responsible for:
- Obtaining and maintaining internet access.
- All charges from your internet service provider.
- Data usage charges from your mobile carrier.
We are not responsible for the unavailability of internet services or related costs.
10. Termination
10.1 Termination by You
You may terminate this EULA by uninstalling the Software and ceasing all use.
10.2 Termination by Us
We may terminate this EULA immediately if you:
- Violate any term of this EULA.
- Engage in cheating, hacking, or fraudulent activity.
- Abuse other users or our staff.
- Engage in illegal activities.
10.3 Effect of Termination
Upon termination:
- Your license to use the Software immediately ends.
- You must uninstall the Software from all devices.
- You lose access to your account, progress, and virtual items.
- No refunds will be provided for purchases.
11. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- Warranties of merchantability and fitness for a particular purpose.
- Warranties of non-infringement.
- Warranties that the Software will be error-free or uninterrupted.
- Warranties regarding data accuracy or reliability.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
- WE SHALL NOT BE LIABLE FOR LOSS OF PROFITS, DATA, OR GAME PROGRESS.
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless Salvage Empire, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, and expenses (including attorney's fees) arising from:
- Your use of the Software.
- Your violation of this EULA.
- Your violation of any laws or third-party rights.
14. Export Compliance
The Software is subject to United States export control laws. You agree to comply with all applicable export and import laws and regulations. You shall not export or re-export the Software to:
- Countries subject to U.S. trade embargoes.
- Individuals or entities on U.S. government restricted parties lists.
- Any destination prohibited by applicable laws.
15. Governing Law and Jurisdiction
This EULA shall be governed by the laws of the United States and the State of [Your State], without regard to conflict of law principles.
Any disputes shall be resolved through binding arbitration as described in our Terms of Service.
16. Third-Party Software
The Software may include third-party software components subject to separate license terms. Such third-party licenses are available within the Software or upon request.
17. App Store Terms
17.1 Apple App Store
If you download the Software from the Apple App Store, you acknowledge and agree that:
- This EULA is between you and Salvage Empire only, not with Apple Inc. ("Apple").
- Apple has no obligation to furnish any maintenance and support services with respect to the Software.
- In the event of any failure of the Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Software. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Software.
- Apple is not responsible for addressing any claims by you or any third party relating to the Software or your possession and/or use of the Software, including but not limited to: (i) product liability claims; (ii) any claim that the Software fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the Software or your possession and use of the Software infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
- You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the Software (e.g., your wireless data service agreement).
17.2 Google Play Store
If you download the Software from Google Play:
- This EULA is between you and Salvage Empire, not Google Inc. ("Google").
- Google has no obligation or liability to you with respect to the Software or this EULA.
- Your use of the Software is also subject to Google Play's Terms of Service.
- Google is a third-party beneficiary to this EULA with respect to your use of the Software downloaded from Google Play.
18. Severability
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Salvage Empire regarding the Software.
20. Amendments
We may amend this EULA at any time by posting the updated version in the Software. Your continued use after changes constitutes acceptance of the amended EULA.
